Akquire Affiliate Program Terms of Service

Important: The commission rate displayed above applies to your public coupon code “bounty” and does not represent your actual commission percentage on team store product sales. (akquire.ca/help for details).

1. Agreement

By registering as an affiliate in the Akquire Affiliate Program (the “Program”), you agree to be bound by these Terms of Service (the “Terms”).

Akquire reserves the right to modify or update these Terms at any time without prior notice. Any new features, tools, or resources added to the Program will also be subject to these Terms. Continued participation in the Program following any changes constitutes your acceptance of the revised Terms.

Violation of these Terms may result in the suspension or termination of your affiliate account and the forfeiture of any outstanding commissions associated with the violation. You participate in the Program at your own risk.

2. Account Terms

To participate in the Program:

You must be at least 18 years of age.
You must be an individual person/organization. Accounts registered through bots, automated systems, or other unauthorized methods are not permitted.
You must provide your legal name, a valid email address, and any other information required to complete the registration process.
Your account and login credentials may only be used by you. Sharing your account with another person is not permitted.
You are responsible for maintaining the security and confidentiality of your account and password. Akquire is not responsible for any loss or damage resulting from your failure to maintain account security.
You are responsible for all content, activity, and transactions conducted through your account.
An individual or legal entity may not maintain more than one affiliate account.
You may not use the Program for any illegal, unauthorized, or fraudulent purpose. You must comply with all applicable laws and regulations, including copyright and intellectual property laws.

3. Affiliate Links, Graphics, and Discount Codes

Upon approval to the Program, you can request your unique Affiliate Coupon Code and internal team 20% off code.

You may use your own created marketing materials on your website, in emails, on social media, or through other permitted communications to promote Akquire and its products, as well as your own.

For accurate tracking and reporting, all affiliate links must use the special link formats provided by Akquire. These links are referred to as “Special Links.”

You will earn referral commissions only on qualifying sales that are properly attributed to your Team Product Sales or Affiliate Coupon Code usages.

Akquire is not responsible for commissions that cannot be tracked because a customer:

Fails to use your Special Link;
Enters an incorrect Affiliate Code;
Fails to use your Discount Code; or
Completes a purchase through another method that cannot be properly attributed to your account.

Whenever possible, affiliate links should direct customers to the specific page, product or service being promoted.

4. Referral Fees and Commissions

A product sale is eligible for a referral commission when a customer completes a qualifying purchase through a properly functioning Team Store or Affiliate Discount Code.

Commissions are payable only on completed and delivered product sales.

If a customer requests a refund, cancellation, or otherwise fails to complete the purchase, any commission associated with that transaction may be deducted or withheld.

Akquire will not pay commissions for sales that are not properly tracked within its systems, even if an affiliate or customer claims that an Affiliate Code or referral link was used.

Akquire reserves the right to withhold or disqualify commissions resulting from fraudulent, illegal, misleading, abusive, overly aggressive, or otherwise questionable sales or marketing practices.

5. Representing Yourself as an Akquire Affiliate

You may promote your participation in the Akquire Affiliate Program; however, you may not misrepresent or embellish your relationship with Akquire.

Unless expressly authorized by Akquire, you may not represent or imply that:

You are an employee, agent, representative, partner, or official spokesperson of Akquire;
Akquire officially endorses or sponsors you, your organization, website, or activities;
Akquire supports, sponsors, endorses, or financially contributes to any charity, organization, cause, or other entity through your participation in the Program.

You may not make statements on behalf of Akquire or otherwise represent that you have authority to act on Akquire’s behalf.

6. Payment Schedule

Affiliate commissions are paid on a monthly basis, generally on the first business day of each month.

Only commissions that have been properly tracked, earned, and are otherwise eligible for payment will be included in affiliate payouts.

7. Customer Relationship

Customers who purchase products through the Program are customers of Akquire.

Accordingly, all Akquire policies and procedures relating to product sales, pricing, customer service, orders, returns, refunds, and product availability apply to those customers.

Akquire reserves the right to determine and modify product pricing and availability at any time.

Because product prices and availability may change, affiliates should not publish or advertise fixed Akquire product prices on their own websites or promotional materials unless expressly authorized by Akquire.

While Akquire will make commercially reasonable efforts to provide accurate product information, pricing, and availability, Akquire does not guarantee that any particular product will remain available or that pricing will remain unchanged.

8. Affiliate Responsibilities

You are solely responsible for the development, operation, and maintenance of your website, social media accounts, promotional channels, and any other platforms used to participate in the Program.

You are responsible for:

Ordering or obtaining any designs or products you wish to promote or sell;
Ensuring that the use of Special Links does not violate any agreement or restriction imposed by a third party or hosting platform;
Ensuring that all information and promotional materials you publish are accurate, truthful, appropriate, and current;
Ensuring that your promotional materials do not infringe upon the copyrights, trademarks, privacy rights, intellectual property rights, or other rights of any third party;
Ensuring that all content you publish is lawful and is not defamatory, misleading, or otherwise prohibited by applicable law;
Maintaining appropriate privacy disclosures regarding the collection, use, storage, and disclosure of visitor information; and
Complying with applicable requirements relating to cookies, advertising, tracking technologies, and third-party services.

9. Compliance With Laws

As a condition of participating in the Program, you agree to comply with all applicable laws, regulations, rules, orders, licenses, permits, and requirements imposed by any governmental authority having jurisdiction over you.

This includes all applicable laws governing advertising, marketing, email communications, privacy, consumer protection, intellectual property, and anti-spam requirements.

You are solely responsible for ensuring that your participation in the Program and all promotional activities comply with the laws applicable to you and your audience.

10. Term and Termination

This Agreement begins when Akquire accepts your application to participate in the Program and continues until terminated by either party.

Either you or Akquire may terminate participation in the Program at any time, with or without cause, by providing written notice.

Upon termination, you must immediately:

Stop using all Special Links and Affiliate Codes;
Remove Akquire links, logos, trademarks, trade dress, and promotional materials from your website and other platforms; and
Stop representing yourself as an Akquire Affiliate.

Akquire reserves the right to discontinue the Affiliate Program at any time.

Unless otherwise provided under these Terms, Akquire will pay any eligible and properly earned outstanding commissions accrued prior to termination.

11. Suspension and Termination of Accounts

Akquire reserves the right, at its sole discretion, to suspend or terminate an affiliate account and refuse current or future participation in the Program or any other Akquire service.

Accounts may be suspended or terminated for violations of these Terms, fraudulent activity, illegal activity, misleading or abusive marketing practices, or any other conduct that Akquire determines to be inappropriate or harmful to the Program.

Where commissions were earned through fraudulent, illegal, misleading, overly aggressive, or otherwise questionable practices, Akquire may withhold or forfeit those commissions.

12. Relationship of the Parties

You and Akquire are independent contractors.

Nothing in these Terms creates or establishes a partnership, joint venture, agency, franchise, employment, sales representative, or other similar relationship between you and Akquire.

You do not have authority to make offers, enter into agreements, make representations, or otherwise act on behalf of Akquire.

You may not make any statement or representation that reasonably suggests otherwise.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Akquire will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, business, or data, arising from or relating to the Program or these Terms, even if Akquire has been advised of the possibility of such damages.

Akquire’s total aggregate liability arising from or relating to the Program or these Terms will not exceed the total referral commissions paid or payable to you under the Program.

14. Disclaimers

The Program and all products and services made available through the Program are provided without express or implied warranties, except where such warranties cannot legally be excluded.

Akquire makes no guarantees regarding the availability, reliability, performance, or uninterrupted operation of the Program, website, tracking systems, or related services.

Akquire does not guarantee that the Program or its systems will operate without interruption, delay, or error and will not be responsible for losses resulting from such interruptions or errors, to the fullest extent permitted by law.

15. Independent Investigation

By participating in the Program, you acknowledge that you have independently evaluated the Program and determined that participation is appropriate for you.

You acknowledge that Akquire may independently seek customer referrals through other affiliates, partners, or marketing channels on terms that may differ from these Terms.

Akquire may also operate websites, businesses, or marketing programs that are similar to or compete with your website, business, or activities.

You acknowledge that you are not relying on any representation, guarantee, promise, or statement other than those expressly contained in these Terms.

16. Arbitration

Any dispute arising out of or relating to these Terms, the Program, any alleged breach of these Terms, transactions conducted through the Program, or your relationship with Akquire or its affiliates will be submitted to confidential arbitration, except where Akquire is entitled to seek injunctive or other appropriate relief through a court of competent jurisdiction for actual or threatened violations of its intellectual property rights.

Arbitration will be conducted in accordance with the rules of the American Arbitration Association then in effect.

The arbitrator’s decision will be final and binding and may be entered as a judgment in any court having appropriate jurisdiction.

To the fullest extent permitted by law, arbitration under these Terms may not be combined with an arbitration involving another party, including through class or representative arbitration proceedings.

17. Governing Law and Miscellaneous

These Terms will be governed by and interpreted in accordance with the laws of Canada, without regard to conflict-of-law principles.

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Akquire.

Subject to this restriction, these Terms will be binding upon and benefit the parties and their respective successors and permitted assigns.

Akquire’s failure to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision or any other provision in the future.

These Terms constitute the entire agreement between you and Akquire regarding the Affiliate Program and supersede all prior agreements, understandings, and versions of the Affiliate Program Terms of Service relating to the Program.

18. Acceptance

By registering for or continuing to participate in the Akquire Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms of Service.
